Privacy Policy

Summary of this Policy
Topiarus, Inc. respects your privacy and will not share personal information with third parties unless you have entered into a business relationship with Topiarus, when we may need to provide some information to fufill the business agreement. We will not “spam” those who have not explicitly expressed a desire to receive such mailings. We maintain security of the site to try to prevent malicious threats. However, we are not responsible for the actions of others, and we reserve the right to prosecute malicious offenders acting against the site.

1. Statement of Intent
Your privacy is important to Topiarius, Inc. (TOPIARIUS). Any information provided to Topiarius during the course of any visit to www.topiarius.com (THE SITE) will be handled according to this policy. TOPIARIUS will act in accordance with current legislation and aim to meet current Internet best practice.

2. Information on visitors
During the course of your visit to THE SITE, information about you and your visit is tracked by "sessions," and in some cases "cookies," without you explicitly providing this information (see 8: Technologies and Definitions). The information stored during these visits — non-personal statistical information — typically is not enough to identify you personally (without significant work). Most Web sites (if not all) practice these techniques because these technologies allow the Web site, and the Web site publisher, to provide better service to you during the course of your visit. This information (not explicitly provided by you via a form) is removed at the end of your visit to the Web site except if any errors occur during your visit (see 6: Offending Actions). Portions of THE SITE may be restricted to authorized individuals only. These restricted areas of the Web site may be accessed by logging in using your personal account on our Web site. During the registration of your account, you will be asked for personal information, including, but not limited to, your name and email address. This information, as well as some session data (such as the time, date, and your IP address – as required by law) is saved and retained by TOPIARIUS.

3. Acquisition of Personal Information
TOPIARIUS uses many technologies that help prevent threats such as "XSS," "Phishing," and "Injection" (see 8: Technologies and Definitions). However, you are the best defense, and TOPIARIUS cannot be responsible for fraudulent activity outside of our control. Before submitting information, please verify that the URL is http[s]://www.topiarius.com/. Please also verify that you press the "log off” button after you are done accessing restricted information.

4. Sharing of Personal Information
Your Privacy is extremely important to TOPIARIUS. Any personal information submitted through THE SITE will never be sold, shared, or disclosed unless required or directed to do so by law. Your information will only be used by TOPIAIUS to provide services beneficial to you. Entering into a business relationship with TOPIARIUS may mean that your information will need to be disclosed to third parties (such as shipping addresses). TOPIARIUS will only disclose this information to the end needed to fulfill the obligations of the business agreement.

5. Email
TOPIARIUS will not send spam email to those who do not explicitly agree to receiving such messages. All mailing lists are on an opt-in, opt-out basis. TOPIARIUS will NEVER randomly email you requesting you to "verify your information". If you receive one of these emails, do NOT provide any personal information, and forward the email to webmaster@topiarius.com immediately. You will receive confirmation emails whenever you initiate action on the Web site (such as change of password, forgotten password, change of personal information, addition of personal information, opt-in or opt-out of any mailing list, etc.). These are considered valid emails to protect your security. If you receive one of these emails without initiating the stated action, follow the instructions in the email and contact webmaster@topiarius.com.

6. Offending Actions
The Web site provides content to you based on a set of variables (where you've been, where you're going). Any deliberate attempt to hack the Web site to show anything other than the intended content raises errors on the Web site. These errors may result in further action by TOPIARIUS (see 7: TOPIARIUS’s response to Offending Actions).

7. TOPIARIUS’s Response to Offending Actions
If any offending actions occur during the time of your visit to THE SITE, TOPIARIUS can use whatever information gathered about you to stop such behavior. This may include informing relevant third parties — such as your email provider, Internet service provider, and local or federal law enforcement agencies — about your content and your behavior. TOPIARIUS may also refuse you access to THE SITE upon awareness of such behavior.

8. Technologies and Definitions
SESSIONS: Sessions are a method of storing information temporarily. Session data is deleted as soon as you leave the Web site and close the connection (for example, close your browser window or click the "log out" button.) Sessions reside on the Web server and are never transferred to your machine.
COOKIES: Cookies, like sessions, store data, but they store the information longer. Cookies are stored on your computer rather than the server and are removed either by instruction from the Web site, an expiration period set by the Web site, or by the user clearing their cookie information from their browser.
SSL: SSL is an encryption between your computer and the Web server that prevents others to see the content of the information you send. When the information transferred is secure, many browsers display a key or a closed padlock in the URL bar and in the status bar at the bottom of the page. You will also know you are communicating over a secure channel whenever the URL begins with "https://". The s (as opposed to "http://") indicates this secure channel.
XSS (Cross-Site Scripting): XSS is a fraudulent process where a rogue Web site piggy backs on an already established connection with another Web site, copying information. While TOPIARIUS is doing what they can to prevent this, it is up to the user to verify where they are submitting their information. Please also always log off after accessing restricted material.
PHISHING: Phishing occurs when one Web site imitates another Web site asking for information. While TOPIARIUS is doing what they can to prevent this, it is up to the user to verify where they are submitting their information. Please verify that the URL is "http[s]://www.topiarius.com/" before submitting information. TOPIARIUS Web sites always have “www” in their URLs. If you do not see “www,” email webmaster@topiarius.com immediately, reporting the fake URL. TOPIARIUS will NEVER randomly email you requesting you to "verify your information." If you receive one of these emails, do NOT provide any personal information, and forward the email to webmaster@topiarius.com at once.
INJECTION: Injection is where a visitor to the Web site "injects" information into the Web site to try to get the site to produce information it was not designed to display, or should not display.

10. Directing Concerns
Concerns about your privacy relating to THE SITE may be directed to TOPIARIUS by written mail to Topiarius, Inc., P.O. Box 30236, Chicago, IL 60630. They may also be submitted to the webmaster via email to weberrors@uturndesigns.com.
